NEPA/WEPA Requirements

The Wisconsin Department of Transportation (WisDOT), on behalf of the Federal Highway Administration (FHWA), is responsible for conducting an environmental review for proposed transportation projects for compliance as a part of the National Environmental Policy Act (NEPA) and Wisconsin Environmental Policy Act (WEPA) processes to fulfill requirements of 42 USC 4332, Wis. Stat. 1.12 and Trans 400.

Construction Environmental Documentation

Additional documentation for specific locations is listed below as a result of subsequent environmental review for potential select sites.

A Categorical Exclusion Checklist (CEC) was prepared for the DOT Aggregate Select Site, which is within WisDOT Right-of-Way.

CEC signed May 15, 2017.

A Categorical Exclusion Checklist (CEC) was prepared for the I-39/90 Corridor Excess Right-of-Way locations, that are within WisDOT Right-of-Way.

CEC signed Nov. 29, 2017.

Environmental Assessment (EA) Re-Evaluation & Supplementation of the EA

WisDOT prepared an updated scan of the environmental impacts anticipated for the I-39/90 corridor due to changes made in the design criteria currently being used for the final design of the proposed I-39/90 capacity expansion work. Subsequently, FHWA and WisDOT determined that a re-evaluation of the original EA/FONSI would be required for the I-39/90 mainline and separate, stand-alone EA’s would be required for the system interchanges with I-43/WIS 81 at Beloit in Rock County and with US 12/18 (Beltline) at Madison in Dane County.

The Re-Evaluation was signed by FHWA with an effective date of October 30, 2014. The document reaffirms FHWA’s October 1, 2010 “Finding of No Significant Impact” (FONSI) for this corridor project.

Environmental Assessment (EA)

An EA was produced for this project. The EA evaluated the purpose and need of the overall project, and the environmental impacts of a number of alternatives developed during the study.
